    No. The Guarantor (cfr.   5. What are "profiling" cookies?

    They are cookies used to track the user's navigation on the network and to create profiles on his tastes, habits, choices, etc. With these cookies can be transmitted to the user's terminal advertising messages in line with the preferences already expressed by the user in online navigating.

     

  6. Is necessary user's consent to install cookies on your terminal?

    For the technical cookies installation is not required users' consent, while is necessary to give the informative (art. 13 of the Privacy Code). Profiling cookies, however, can be installed on the user's terminal only if he has given its consent after being informed with simplified procedures.

     

  7. How does the site owner must provide the Simplified information and to request permission to use the profiling cookies?

    As determined by the Guarantor in the measure referred to question. 4, the informative must be set on two levels.

    When the user accesses a website (on the home page or any other page), has to immediately appear a banner containing a "short" initial informative, the request for consent to the cookies use and a link to access more " disclosuresextended" disclosures. In this page, the user can find more detailed information about cookies and choose which specific cookies authorize.

     

  8. How should be realized the banners?

    The banner has to be sized to cover some of the content of the web page which the user is visiting. It has to be eliminated only through an active intervention by the user ,  through the selection of an element in the page below.

     

  9. What information should contain the banner?

    The banner has to specify that the site uses profiling cookies, possibly of "third parties", which allow you to send advertising messages in line with your preferences.

    It should contain the link to the extended informative and the indication which, through that link, you can refuse consent to the installation of any cookies.

    It should specify that if the user chooses to continue "jumping" the banner, agrees to the cookies use.

     

  10. How can be documented the consensus acquisition done through the banner use?

    To track the acquired consensus , the site owner can use a special technical cookie, system not particularly invasive and does not requires a further consent.

    In the presence of this "document", it is not necessary that the short information be reproposed to the second user's visit on the site, subject to the possibility for the latter to refuse consent and / or change, at any time and in an easy manner , their options, for example through access to the extended informative , that has to be linkable from each page.

     

  11. The online consent for the cookie use can be asked only through the banner use?

    No. The site owners always have the option to use other methods than the one identified by the Guarantor in the order mentioned above, as long as the method chosen satisfies all the conditions of validity of the consent required by the law.

  12. Even the owners of Websites using only technical cookies are obliged to use the banner?

    No. In this case, the site owner can give the informative to users with the methods he considers most appropriate, for example, also by entering the relevant information in the privacy policy stated on the site.

     

  13. What has to indicate the "extended" information?

    It should contain all the elements provided by the law, to describe in detail characteristics and purposes of cookies installed by the website and to allow the user to select / deselect individual cookies.

    It should include the current link to third parties' informations and consent forms with whom the owner has entered into agreements for the cookies installation through his website.

    It should recall, finally, the possibility for the user to express their own options about cookies through the browser settings.

     

  14. Who is obliged to provide the information and to request consent to use cookies?

    The website owner who installs profiling cookies.

    For third-party cookies installed by the site, the disclosure requirements and consent weighing on third parties, but the site owner, such as technical intermediary between them and the users, is required to enter in the extended information the links updated to the third parties' information and consent forms.

  15. The use of cookies should be notified to the Guarantor?

    Profiling cookies, which usually remain in the time, are subject to the notification, while cookies which have different purposes and which fall within the category of technical cookies, are not to be notified to the Guarantor.

     

  16. When enter into force the measures prescribed by the Guarantor with the order of 8 May 2014?

    The Guarantor has provided for a transitional period of one year from the publication of the measure in the Official Journal to allow stakeholders to come into compliance. This period will end June 2, 2015.
